Kerala HC flags non-compliance of pre-arrest norms leading to release of accused

Kochi, Flagging instances of the accused getting bail because the investigating officer did not comply with pre-arrest formalities, the Kerala High Court on Thursday directed all criminal courts in the state to ensure compliance with pre-arrest formalities as stipulated in several Supreme Court judgments before considering remand applications.. Kerala HC flags non-compliance of pre-arrest norms leading to release of accused. The high court specifically directed that before ordering remand, the magistrate or judge should get an endorsement in the proceedings sheet stating that the pre-arrest formalities have been complied with and the accused has no objection in this regard.. “In the event of non-compliance, the magistrate or the special judge … must ensure compliance of the formalities by the investigating officer and remand is to be considered only after ensuring compliance of the formalities,” Justice A Badharudeen said.. The high court also said that if the magistrate or judge notes deliberate intention by the investigating officer or arresting officer to not comply with the formalities, they shall recommend disciplinary proceedings against such officers.. The high court issued the directions while hearing the bail application of a deputy range forest officer accused of sexually assaulting a female beat forest officer at his workplace.. According to the prosecution, on February 4, while the beat forest officer was serving food to her colleagues in torchlight due to a power failure at the Deputy Range Office, the accused touched her inappropriately.. The high court said that on perusal of the First Information Statement, “the allegations necessary to constitute the offences alleged are well made out, prima facie and the absolute innocence canvassed by the appellant’s counsel is found to be unacceptable”.. It, however, set aside the special judge’s order denying regular bail to the accused and granted him the relief in view of his status as a first-time offender.. “The appellant shall be released on bail on his executing a bond for ₹1,00,000, with two solvent sureties, each for the like amount, to the satisfaction of the special court concerned.. “The appellant shall not intimidate the witnesses or tamper with evidence. He shall co-operate with the investigation and shall be available for interrogation,” the high court said.. It directed the accused to appear before the investigating officer as and when directed and not to make any inducement, threat or promise to any person including the complainant acquainted with the facts of the case, so as to dissuade them from disclosing such facts to any police officer.. “The appellant shall not disturb the de facto complainant in any manner during the currency of bail hereby granted, if any such event is reported or comes to the notice of this court, the same alone is a reason to cancel the bail hereby granted,” the high court said.. It directed the High Court Registry to forward a copy of the judgme

Absolutely certain that global warming has accelerated in past decade: Study

Global warming has accelerated in the past ten years with a new study concluding it with 98% certainty. While scientists had started noting signs of rapid acceleration of warming in recent years, this is the first study to say it with scientific confidence.. This recent rate is higher than in any previous decade since the beginning of instrumental records in 1880. (Bloomberg photo). After accounting for known natural influences like El Niño events, volcanic eruptions and solar variations on global temperature, the research team detected a statistically significant acceleration of the warming trend.. Over the past ten years, the estimated warming rate has been around 0.35°C per decade, depending on the dataset, compared with just under 0.2°C per decade on average from 1970 to 2015, the Potsdam Institute for Climate Impact Research (PIK) said on Friday evening.. This recent rate is higher than in any previous decade since the beginning of instrumental records in 1880, the authors emphasised.. HT reported on January 15 that global temperatures over the past three years (2023-25) averaged more than 1.5 degrees Celsius (C) above pre-industrial levels, marking the first three year period which has exceeded the threshold, Copernicus Climate Change Service (C3S) said.. Berkeley Earth, which focuses on land temperature data analysis has warned that the warming spike in 2023 to 2025 appears to have deviated significantly from the previous largely linear trend. The warming spike in 2023 to 2025 appears to have deviated significantly from the previous trend. If we were to assume that global warming was continuing at the same rate as during the 50-year period 1970-2019, then the 2023 to 2025 excursion would be by far the largest deviation from that trend, Berkeley Earth said.. “We can now demonstrate a strong and statistically significant acceleration of global warming since around 2015,” said Grant Foster, a US statistics expert and co-author of the study, which was published in Geophysical Research Letters.. Also Read: Global temperatures breach 1.5°C threshold for 1st time in 3 years in a row. Most importantly, the study has also concluded that if the warming rate of the past 10. years continues, the Paris Agreement 1.5°C warming limit will be breached by 2030.. “Stopping this trend is in our hands: studies show that global warming will stop around the time humanity reaches zero CO2 emissions, but it can hardly be reversed. In the current political climate, however, it is quite possible that warming may continue its fast pace or even accelerate further. This much is clear: if the warming rate of the past 10 years continues, the Paris Agreement 1.5°C warming limit will be breached by 2030,” the study states.. Short-term natural fluctuations in global temperature caused by El Niño, volcanic eruptions, and solar cycles can mask changes in the long-term rate of warming. In their data analysis, which is based on measurement data, the two research

When will Noida International Airport open? What we know after key DGCA license granted

The upcoming Noida international airport might be set to begin operations within the next two months, after the Directorate General of Civil Aviation (DGCA) on Friday granted an aerodrome license to the facility, clearing its last hurdle before launch.. Spread across 1,300 hectares in Uttar Pradesh’s Jewar, the Noida International Airport cleared its ultimate hurdle – getting an aerodrome license, before kickstarting operations a day after it received mandatory security clearance from the Bureau of Civil Aviation Security (BCAS). (Sunil Ghosh/Hindustan Times file photo). A government statement said that the airport has been licensed under the Public Use category for all-weather operations and that it meets the safety and operational standards prescribed by the regulator.. The development of the Noida International Airport (NIA) is part of the Ministry of Civil Aviation’s broader vision for building a robust aviation ecosystem, it stated.. When will the airport open?. After the DGCA approval, cargo and domestic flight operations are expected to begin within 45 days, as mandated under the project plan.. Spread across 1,300 hectares in Uttar Pradesh’s Jewar, the airport facility cleared its ultimate hurdle – getting an aerodrome license, before kickstarting operations a day after it received mandatory security clearance from the Bureau of Civil Aviation Security (BCAS).. The BCAS had earlier flagged several issues that pushed back the inauguration, which was initially scheduled for September 2024. It had raised concerns over potential interference with the Doppler Very High Frequency Omnidirectional Range (DVOR), a navigation aid that provides aircraft with bearing information relative to a ground station.. Questions were also raised over a steel wall near the DVOR, which staged a chance to affect the safety of aircraft during landing and take-off. BCAS questioned the makeshift structure and asked the airport operator to replace it with a permanent wall.. “While constructing the permanent wall will take a few months, BCAS has granted clearance on the condition that a permanent structure is built within six months,” an official aware of the matter said.. About the Noida International Airport. Expected to handle about 12 million passengers annually in its first phase, the NIA is being developed as the national capital region’s second major airport after Indira Gandhi International Airport in New Delhi.. The facility features a runway with orientation 10/28 and dimensions of 3,900 m × 45 m, supported by an Instrument Landing System (ILS) and Aeronautical Ground Lighting (AGL) system, enabling 24×7 operations.. “The aerodrome has parking stands for 24 Code C and 02 Code D/F aircraft and is equipped with ARFF Category 9 facilities capable of handling wide-body aircraft such as the Boeing 777-300ER,” a statement by the government read.. The airport is being developed in four phases along with a multi-modal cargo hub. After the completion of
