Massachusetts mom offers to admit killing 3 children as prosecutors push back on move that could dodge prison

NEWYou can now listen to Fox News articles!. A Massachusetts mother accused of strangling her three young children is offering to formally admit she killed them in a dramatic legal move that could shift the focus of her trial to her mental state — and potentially keep her out of prison.. Lindsay Clancy, who was a Duxbury labor and delivery nurse, is willing to formally admit in writing to her role in the killings, according to a new motion filed by defense attorney Kevin Reddington.. The filing, obtained by WCVB5, comes just one week after a judge denied Clancy’s request to split her trial into separate phases that would have divided the question of whether she committed the acts from her mental state at the time.. In asking the court to reconsider, Reddington argued that Clancy’s admission would leave her mental condition as the central issue for a jury to decide. The filing states that she is willing to formally acknowledge her involvement in the conduct that led to the deaths of her three children.. UTAH CHILDREN’S BOOK AUTHOR KOURI RICHINS CONVICTED IN HUSBAND’S MURDER. If she is ultimately deemed mentally unfit to stand trial, she could be committed to a secure mental health facility rather than face prison under Massachusetts law.. Prosecutors have not agreed to the proposal. They previously opposed the idea of separating the trial, arguing that the evidence presented in each phase would be nearly identical.. Clancy was indicted in September 2023 on three counts of murder and strangulation in connection with the deaths of her children, 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan.. Prosecutors allege that Clancy used exercise bands to strangle the children inside the family’s Duxbury home on Jan. 24, 2023, before attempting to take her own life.. MASSACHUSETTS MOTHER ACCUSED OF STRANGLING HER 3 CHILDREN SEEKS INSANITY DEFENSE. Her husband, Patrick Clancy, returned home to what court documents describe as silence. He found blood on the floor and an open window before discovering his wife outside with cuts to her wrists and neck. She survived the apparent suicide attempt.. Previously unsealed records, spanning nearly 300 pages, detail Clancy’s actions in the hours leading up to the killings.. FOLLOW THE FOX TRUE CRIME TEAM ON X. According to court documents, she had taken one of her children to a pediatrician appointment earlier that day and contacted a CVS pharmacy about a prescription. Investigators say she then asked her husband to pick up the food and medication, leaving her alone with the children.. Athena Strand photo shows deadly ride with FedEx driver who admitted killing girl during Christmas delivery

Prosecutors released a haunting black-and-white photo showing 7-year-old Athena Strand moments before her abduction and death at the hands of FedEx driver Tanner Horner while delivering her Christmas present. The image, released on Tuesday, shows Athena behind Horner on the day she was strangled in Texas in November 2022; she appears uneasy as Horner concentrates on the road ahead. Horner, 34, a former delivery driver accused of kidnapping and strangling Athena after hitting her with his van during a delivery, admitted to capital murder in a Tarrant County courthouse on Tuesday morning. After jurors were seated, Judge George Gallagher asked for the plea; “Guilty, your honor,” Horner replied, and the judge accepted.

Horner admitted to abducting Strand while delivering a package to her father’s home in Paradise, a town of fewer than 500 people about 60 miles northwest of Dallas. Her body was found on December 2, two days after she was reported missing, less than 10 miles from the home. Authorities said Horner was delivering a package of Barbie dolls that were intended to be Strand’s Christmas present. Athena was set to return to Oklahoma with her mother after the holidays and had been staying with her father, Jacob Strand, and stepmother, Ashley Strand, in Wise County.

According to the arrest warrant, Horner told investigators that he strangled the 7-year-old after accidentally hitting her with his van while delivering at her father’s home. He said Strand wasn’t seriously hurt after he hit her while backing up, but he panicked and put her in his van. On Tuesday, Ashley Strand testified about the immediate aftermath when she realized her stepdaughter had vanished. She recalled thinking perhaps she was hiding somewhere. The only thing she noticed as unusual on the property was a Walmart package containing Barbie dolls that had been ordered for Athena as a Christmas present and had been left in front of an abandoned trailer on the property.

Athena was reported missing, and an Amber Alert was issued, triggering 72 hours of searching. Wise County’s former Sheriff Lane Akin testified that the search efforts for the 7-year-old were a grassroots effort with community members standing shoulder to shoulder if she was found.

WATCH: Tybee Island teen takeover erupts in panic after police say gunfire broke out along the pier

Teens taking part in what authorities described as a takeover on Tybee Island, Georgia, prompted panic when gunfire was reported along the pier. The Tybee Island Police Department said officers responded around 6:30 p.m. Saturday after hundreds gathered near the Tybee Island Pier and Pavilion, a popular spot in the laid-back beach community. During the unpermitted pop-up event, officers heard a single gunshot and the crowd began to scatter. Video released by the department showed large numbers of teens running away. Visitors on the island described the scene as chaotic; one said there were about 15 girls who yelled at them the night before for no reason, adding that the crowd appeared to be comprised of drunk white girls—a “cloud of white girls” walking around.

After reviewing 911 calls and video, detectives said they believe the gunshot may have originated from the beach below. The department is now looking for two individuals seen emerging from the darkness beneath the end of the pier and pavilion, and they believe these people may have information about the investigation. Anyone who knows who these individuals are, or if one of them is you, is asked to contact Detective Sam Stuber at (912) 786-5600 or sstuber@cityoftybee.gov.

Tybee Island is a barrier island on Georgia’s Atlantic coast, about 18 miles east of downtown Savannah.
