Officials told PEOPLE that after her misdemeanor, the “Oops !…I Did It Again” singer would be offered a “wet-reckless” because she had no prior DUI record. She had also not been involved in an accident, and her blood alcohol level was low at the time of arrest.
A “wet-reckless” allows a person who has been arrested to plead guilty for reckless driving with drugs and alcohol. They are placed on probation for a period of 12 months and receive credit for the time spent in jail. It is unlikely that the “Lucky” singer will be given credit for the time she spent in custody. She was arrested the night of the 4th and released the next morning. If she accepts the offer, she will be required to take a DUI course and pay fines and fees mandated by the state.

Officials stated that the resolution was “common” for individuals who “demonstrate self-motivation” to address underlying issues via rehabilitation or a drug-and alcohol treatment program. The “Crossroads’ actress entered a treatment center voluntarily earlier this month before her arraignment.
“Her sons played a major role in getting her into rehab. They have been very clear with her. “They just want her healthy,” a publication source said. “She was very upset after her arrest. She’s afraid of going to prison. It took her weeks to realize that rehab was the best option.”

Spears won’t have to appear personally on May 4 because it is a misdemeanor. Her attorney will represent her in person. An expert in law had previously told PEOPLE that her decision to seek legal help would only strengthen her case.
“[Voluntarily seeking medical treatment] shows the court that the person takes the situation seriously, before they’re told to do anything,” said Bobby Taghavi. Taghavi is a managing partner of the personal injury law firm Sweet James. He is also a former prosecutor at the Orange County District Attorney’s Office. Taghavi is not involved in Spears’s case.
“Judges respond better to proactive accountability rather than last-minute “damage control,” he added.

Taghavi believed that it was unlikely that Spears would be sent to jail for the incident.
“It is not a guarantee of avoiding custody, but most judges will consider it as mitigation, particularly if it’s documented and consistent, showing real commitment,” he said. “But the court is still going to look at the facts and judges prefer proof that you participated or completed the program, not just an announce.”
He explained that a typical DUI case usually results in a four-month suspension. While jail is technically possible, it is “often” not the focus of the case. He said that similar outcomes include probation, fines and penalties, as well as DUI school.
