Kerala HC flags non-compliance of pre-arrest norms leading to release of accused

 Kochi, Flagging instances of the accused getting bail because the investigating officer did not comply with pre-arrest formalities, the Kerala High Court on Thursday directed all criminal courts in the state to ensure compliance with pre-arrest formalities as stipulated in several Supreme Court judgments before considering remand applications.. The high court specifically directed that before ordering remand, the magistrate or judge should get an endorsement in the proceedings sheet stating that the pre-arrest formalities have been complied with and the accused has no objection in this regard.. “In the event of non-compliance, the magistrate or the special judge … must ensure compliance of the formalities by the investigating officer and remand is to be considered only after ensuring compliance of the formalities,” Justice A Badharudeen said.. The high court also said that if the magistrate or judge notes deliberate intention by the investigating officer or arresting officer to not comply with the formalities, they shall recommend disciplinary proceedings against such officers.. The high court issued the directions while hearing the bail application of a deputy range forest officer accused of sexually assaulting a female beat forest officer at his workplace.. According to the prosecution, on February 4, while the beat forest officer was serving food to her colleagues in torchlight due to a power failure at the Deputy Range Office, the accused touched her inappropriately.. The high court said that on perusal of the First Information Statement, “the allegations necessary to constitute the offences alleged are well made out, prima facie and the absolute innocence canvassed by the appellant’s counsel is found to be unacceptable”.. It, however, set aside the special judge’s order denying regular bail to the accused and granted him the relief in view of his status as a first-time offender.. “The appellant shall be released on bail on his executing a bond for ₹1,00,000, with two solvent sureties, each for the like amount, to the satisfaction of the special court concerned.. “The appellant shall not intimidate the witnesses or tamper with evidence. He shall co-operate with the investigation and shall be available for interrogation,” the high court said.. It directed the accused to appear before the investigating officer as and when directed and not to make any inducement, threat or promise to any person including the complainant acquainted with the facts of the case, so as to dissuade them from disclosing such facts to any police officer.. “The appellant shall not disturb the de facto complainant in any manner during the currency of bail hereby granted, if any such event is reported or comes to the notice of this court, the same alone is a reason to cancel the bail hereby granted,” the high court said.. MP man, out of jail, kills teen; locals see him ‘eating victim’s brain’, ‘drinking blood’

 A 46-year-old man, who was released from jail a few weeks ago in a case related to the murder of his wife, was arrested on Thursday for allegedly killing a 16-year-old boy and trying to eat his flesh and drink his blood in Samanna village of Madhya Pradesh’s Damoh district, police said.. The accused, Gudda Patel, a resident of Samanna village, had earlier been arrested for slitting his wife’s throat a few years ago. The police officer further said that villagers claimed they saw Patel trying to eat flesh from the boy’s head and drink blood from his hands after they reached the spot.. “When the villagers heard the screams, they rushed to the spot and found Patel eating flesh from the boy’s head and drinking blood from his hands,” Pandey added.. Villagers attempted to catch the accused, but he threatened them with the hammer. “He had hidden in agricultural land near the village. The villagers chased him and started pelting stones at him. Veteran journalist Narayan Bareth passes away after cardiac arrest in Jaipur

 Veteran journalist Narayan Bareth passed away here after suffering a cardiac arrest while undergoing treatment for pneumonia, a family member said on Saturday.. Former chief minister of Rajasthan Ashok Gehlot said Narayan Bareth had carved a distinct identity through public-interest journalism while working with reputed organisations such as the BBC.  Kochi, The Customs Commissionerate has arrested five persons from West Bengal and Assam in connection with the smuggling of high-end used cars from Bhutan, officials said on Saturday.. In a statement, Customs said the arrested persons were Biswadip Das of Jaigaon in Jalpaiguri district of West Bengal, Dipak Patowary of Paltanbazar in Kamrup district, Ayub Ali of Jogighopa in Bongaigaon district, MD Mostafa Ahmed of Boladmari in Goalpara district and Jalal Mandal of Chapar in Dhubri district. All four belong to Assam.. Customs officials said Patowary was the District Transport Officer of Bongaigaon in Assam.. The arrests were made following a widespread investigation conducted in Assam and West Bengal, with the assistance of police and Customs formations in the northeastern states, officials said.. “During an investigation by Assam Police, they were found to have registered 460 such vehicles using forged documents. The vehicles include foreign-made cars as well as Indian-made vehicles that were exported earlier and later smuggled back into the country without payment of Customs duties. These were then illegally registered using forged documents,” Customs said.. The Customs Commissionerate, Kochi, launched “Operation Numkhor” last year after it was found that used vehicles, mostly high-end SUVs from Bhutan, were being illegally smuggled into India, re-registered in various states, and sold to buyers who claimed they were legally imported.. Last year, Customs seized several vehicles, including some belonging to film actors in Kerala, which had been sold to them by persons involved in the illegal smuggling of vehicles from Bhutan.. The Customs statement said Das, who was arrested on February 22 and is an employee of a major IT firm, was the mastermind behind the smuggling of vehicles from Bhutan.. He was apprehended near the India-Bhutan border and later brought to Kochi on a transit warrant before being remanded in judicial custody.. Customs will soon approach the court seeking the custody of the arrested persons for further investigation, officials said.. According to Customs, a recent report by the Comptroller and Auditor General of India found that 15,849 vehicles with the same chassis and engine numbers were registered in multiple northeastern states..
