Need to curb filing appeals against court orders as a default reaction:Secys, lw officers agree

New Delhi, A tendency among central ministries and departments to file appeals against court orders as a “default reaction” rather than as a considered policy decision was flagged as a “key challenge” to curb litigation in which the government is a party.. Need to curb filing appeals against court orders as a default reaction:Secys, lw officers agree. At a recent conference on effective and efficient management of government litigation, over two dozen Union secretaries and top law officers recommended a clear appeal-filtering criteria in service and other matters, nomination of a designated officer in each department for coordinated handling of litigation, and mechanisms for time-bound implementation of court judgments so that repetitive and contempt litigation is minimised.. The conference, organised here on Saturday by the Union law ministry, noted key challenges such as repetitive service litigation due to non-uniform implementation of legal position, lack of due consultation before filing counter affidavits, divergent positions taken by different ministries, lack of coordination between departments and panel counsels, and a tendency to file appeals as a default reaction rather than as a considered policy decision.. According to officials and details shared by the ministry, in infrastructure and compensation matters, concerns were raised about escalating land compensation litigation and mounting interest liabilities, routine challenges to arbitral awards, technical complexity in infrastructure contracts leading to inadequate legal vetting.. Fragmented coordination between technical divisions and legal teams, and under-utilisation of alternate dispute resolution and pre-litigation mediation were also flagged as areas of concern.. A central emphasis of the deliberations was on reducing avoidable litigation and delays in litigation filing through robust filtering, better coordination and early dispute resolution.. The law ministry had in February last year told Rajya Sabha that the central government is a party in nearly seven lakh cases pending across courts, with the finance ministry alone being one of the litigants in nearly two lakh cases.. Citing data available on the Legal Information Management & Briefing System , Law Minister Arjun Ram Meghwal said, “There are about seven lakh cases pending where the Government of India is a party. Out of these, in about 1.9 lakh cases, the Ministry of Finance is mentioned as a party.”. This article was generated from an automated news agency feed without modifications to text.

Jharkhand man carries infant’s body in box after hospital ‘denies ambulance’

A man in Jharkhand’s West Singhbhum district carried his dead infant in a cardboard box from a government hospital to his house, allegedly because he was denied an ambulance, the baby’s father told the media on Sunday.. Ramkrishna Hembram said he carried the body for 20 km to his house in Bandgaon Block.. Hospital authorities, however, denied the allegations, stating that neither the father nor anyone else from his family had requested an ambulance.. Ramkrishna Hembram, a resident of Bangrasai village, had admitted his pregnant wife Rita Tiria to the Chakradharpur sub-divisional hospital on Thursday. She gave birth to the baby on Saturday, but it died shortly after. “The doctors didn’t take proper care during and after delivery, due to which the baby died. After its death, health workers kept pressing us to remove the dead body. We demanded an ambulance or any other vehicle from the hospital to take the dead body back to our village (in Bandgaon Block), but they refused. Then, I put my baby in a leftover cardboard box and left for my village,” Hembram told the media on Sunday.. The doctor in charge of the Chakradharpur sub-divisional hospital, Dr Anshuman Sharma, however, denied the allegations and said, “Neither the father of the dead newborn baby nor anyone from his family requested me or any authority of the hospital for an ambulance. Had they approached us, we would have surely arranged an ambulance for them,” Dr Sharma said.. Chakradharpur sub-divisional officer Shruti Rajalakshmi said the district authority is conducting an inquiry into matter. “Appropriate action will be taken soon,” she said.. The West Singhbhum civil surgeon could not be contacted as the post had been lying vacant for the past eight days.

Centre vs Mamata Banerjee: Response sought from TMC govt on President Murmu’s Bengal visit row

The political slugfest over President Droupadi Murmu’s West Bengal visit escalated on Sunday, with the Union home ministry seeking a report from the state government over the alleged protocol breach, Prime Minister Narendra Modi sharpening his attack on the Trinamool Congress (TMC), and chief minister Mamata Banerjee hitting back.. After the PM Modi’s jibe, Mamata Banerjee hit back, accusing the Prime Minister of insulting India’s constitutional head. (ANI/PTI). In a letter to West Bengal Chief Secretary Nandini Chakravorty, Union home secretary Govind Mohan sought a response by 5pm on Sunday regarding alleged violations of the “Blue Book” rules during the President’s Saturday visit to a tribal event in north Bengal.. The “Blue Book” is a confidential document that outlines security and protocol rules for the President, vice-president, the Prime Minister, and their families.. ALSO READ | ‘Bengal being targeted, no breach of protocol’: Mamata Banerjee reacts to ‘insult to President’ row. “The home secretary has sought a response on the absence of the CM, the chief secretary and the director general of police to receive the President, which is a serious violation of the Blue Book rules. The Centre has taken note of the fact that only the Siliguri mayor was present to receive her,” said an officer in Delhi aware of the details. It was not immediately clear if the TMC government submitted a reply.. In Delhi, Modi stepped up his attack on the Bengal government, accusing it of disrespecting the President. “This is not only an insult to the President but also an insult to the Constitution of the country and the great traditions of democracy. It is an insult to a personality who has achieved great heights through a life of struggle,” he said during the inauguration of multiple infrastructure projects worth ₹33,500 crore.. Banerjee hit back, accusing the Prime Minister of insulting India’s constitutional head. At a sit-in protest in Kolkata over the SIR exercise, she held up a photograph showing Modi seated while the President stood next to him.. “The picture shows that the PM is seated when the President is standing. We never do that. It is the BJP which carries the culture of insulting the President, not us,” she claimed, displaying the photograph as “evidence”. The photo was of a March 2024 event when President Murmu awarded LK Advani the Bharat Ratna at his New Delhi residence, according to news agency PTI.. Amid US-Iran conflict, EAM S Jaishankar to brief parliament on West Asia tensions

External affairs minister S Jaishankar will make a statement on the ongoing situation in West Asia and address concerns about safety of Indians living in gulf countries, in Parliament on Monday, when the second half of the budget session will begin.. External affairs minister S Jaishankar will make a statement on the ongoing situation in West Asia and address concerns about safety of Indians living in gulf countries, in Parliament on Monday, when the second half of the budget session will begin. (ANI). The session, which is set to be stormy, will start amid renewed confrontation between the ruling National Democratic Alliance (NDA) and the opposition over the no-confidence motion against Lok Sabha Speaker Om Birla, conflict in West Asia, and the India-US trade deal. The session is expected to set the tone for the upcoming assembly elections in four states and one Union territory.. The revised business of the House shows that Jaishankar “will make a statement on the situation in West Asia.” The statement assumes significance as the Opposition is expected to try to corner government over the international issues and particularly on the US administration’s waiver to India to buy Russian oil for 30 days amid the global doldrums on oil supply through Iran-controlled Strait of Hormuz, the route accounting for nearly a quarter of global oil supply.. The problems with such Ministerial statements are that (i) they convey little of value over and above that is already known; and more importantly (ii) MPs are not given an opportunity to seek clarifications or ask questions,” Congress general secretary and lawmaker Jairam Ramesh said in a post on X.. Even as the Opposition has indicated its stance ahead of the budget session that is going to target the government over its alleged compromise with the US administration, the NDA is likely to attack the Opposition over the no-confidence motion against Birla and the alleged lack of protocol to President Droupadi Murmu during her latest visit to West Bengal.. Prime Minister Narendra Modi has already dubbed the incident as “shameful and unprecedented”. “Everyone who believes in democracy and the empowerment of tribal communities is disheartened. The pain and anguish expressed by Rashtrapati Ji, who herself hails from a tribal community, has caused immense sadness in the minds of the people of India. The TMC government of West Bengal has truly crossed all limits. Their administration is responsible for this insult to the President,” Modi said.. West Bengal is among the states that will go to assembly polls in April-May this year.. The Opposition, on the other hand, is likely to corner the government over foreign policy and the India-US relations.. “India’s foreign p

Hotel body says LPG price hike could force review of menu rates

The increase in LPG cylinder prices has raised concerns in the hospitality sector, with hotel associations warning that rising fuel and ingredient costs could lead to higher food prices in the coming weeks.. Hotel body says LPG price hike could force review of menu rates. The price of domestic LPG cylinders increased by about ₹60, while 19-kg commercial cylinders used by hotels became costlier by ₹114.5 from March 7. The hike comes amid rising global energy costs linked to tensions in West Asia and marks the second price increase in less than a year.. PC Rao, president of the Bengaluru Bruhat Hotels Association, said the impact on restaurants and hotels has been compounded by the withdrawal of an earlier discount on commercial cylinders.. “Hoteliers earlier received a discount of around ₹150 on the maximum retail price (MRP) of commercial LPG cylinders. That was stopped from March 1, and now the MRP has increased. So the total impact on us is around ₹265 per cylinder,” he said.. Rao said the increase comes at a time when hotels are already facing rising costs for several key food preparation ingredients. According to him, cooking oil prices have increased by about ₹15 to ₹20 per kilogram. Coffee bean prices have also risen, while dry fruits, particularly cashews widely used in gravies and sweets, have seen a price increase of nearly 20% to 25%.. Industry representatives said the combined rise in fuel and ingredient costs could eventually force hotels in Bengaluru to review menu prices.. Reacting to the LPG price increase, Karnataka chief minister Siddaramaiah criticised the Union government, saying the decision would add further pressure on households already grappling with inflation.. “The latest increase in LPG cylinder prices is deeply concerning for millions of households across India. At a time when families are already battling relentless inflation, yet another burden is being placed on the kitchens of ordinary citizens. Domestic cylinders have increased by around ₹60, adding further pressure on household budgets,” he said.. Siddaramaiah said the increase was linked to the Union government’s foreign policy decisions, arguing that India had compromised its strategic autonomy by aligning closely with the United States and weakening long-standing energy partnerships with countries such as Russia and Iran. “This crisis is not accidental but the result of a foreign policy that mistakes submission for strategy,” he said.. Quoting India’s first prime minister, he added: “Pandit Jawaharlal Nehru had warned with remarkable clarity: ‘Foreign policy is the outcome of economic policy.’ When diplomacy becomes spectacle rather than strategy, its consequences inevitably reach the kitchens of the poor and the middle class.”
