A former New York City Police Officer, sentenced to 3-9 years in prison after fatally throwing a cooling unit at a fleeing criminal, will be freed from prison as he appeals the conviction. Aidala stated that they were “very pleased, but not surprised” that the Appellate Division determined that there were legitimate appellate issues with Sgt Duran’s case. “It was evident to the Court that Sgt Duran is neither a flight risk, nor a threat to the community. He was entitled to stay at home with his wife and children during the pendency of the appellate. “Duran, a 38-year-old married father of three was convicted in February of manslaughter for the August 2023 deaths of Eric Duprey. Duran claimed that he threw the Igloo cooler to protect other officers against Duprey who was riding a motorized bike along a sidewalk. He rejected Duran’s claim that his actions were justified. The police had enough time to investigate and catch him on a different day.
