According to a statement by the actor’s lawyer, the family of Halyna Houtchins, the cinematographer who was killed on the “Rust,” movie set in 2021 and Alec Baldwin, reached an undisclosed settlement in a wrongful death lawsuit.
The lawsuit was filed in February in Santa Fe against Baldwin, the film’s production company, its producers, and other key members. It alleged numerous violations of industry standards.
According to the statement, Matthew Hutchins, the widower of Halyna Hutchins, will serve as an executive producer on film.
“We have reached a settlement with the producers of Rust (including Alec Baldwin, Rust Movie Productions LLC) subject to court approval. Our case will be dismissed as part of the settlement. With all the original principal actors on board, Rust will resume filming in January 2023. I do not want to engage in recriminations, or assign blame (to Mr. Baldwin or the producers). We all believe Halyna died tragically. Hutchins stated that he was grateful to the producers and entertainment industry for coming together to pay tribute Halyna’s final work.”

“Throughout this difficult process everyone has kept the specific desire for Halyna’s son in their hearts. “We are grateful to everyone that contributed to the resolution to this tragic and painful circumstance,” Alec Baldwin’s attorney Luke Nikas of Quinn Emanuel stated in a statement.
Joel Souza, the film’s director, was also hurt during the shooting. He is expected to return to the movie.
“Those of us who had the opportunity to spend time with Halyna know her to be incredibly talented, kind, creative and a source for incredible positive energy. I wish the world could have had the opportunity to meet her in different circumstances. Her amazing work is a testament to that. I have tried to heal and decided to make the decision to return to directing the film with Matt and the Hutchins families. Although it is bittersweet, I am happy that we will now complete the work Halyna, me and Matt started. My entire effort in this film will be dedicated to Halyna’s legacy. I want to make her proud. “It is a privilege for me to see this through on her account,” Souza stated in a statement.
Rust Movie Productions LLC, through Melina Spadone, Pillsbury Winthrop Shaw Pittman as its attorney, stated: “We are pleased that the parties came together and resolved this matter which, subject to court approval marks an important step forward in honoring Halyna’s life and celebrating her work.”
The lawsuit claimed that producers and production companies “cut corners” in hiring crews, specifically noting that they “knowingly employed an unqualified armorer” and required her to work as an assistant props master.
Jason Bowles, an advocate for Hannah Gutierrez Reed who was the armorer on “Rust,” stated that they hope the settlement will be recognized as a “measure to Justice.”
“Hannah is grateful for the Hutchins family’s settlement and that the parties were able constructively to resolve the civil lawsuit. Bowles stated that she is hopeful that the district attorney office will recognize that some measure of Justice was achieved in relation to this tragic accident and that they will not pursue criminal charges.
CNN was informed by a spokesperson for Santa Fe District Attorney that the settlement agreement would not affect the ongoing criminal investigation in the case.
Heather Brewer, spokesperson for the Office of the First Judicial District Attorney of New Mexico stated that while civil suits can be settled privately and may involve financial awards, criminal cases are only about facts. “If the facts and evidence warrant criminal prosecution under New Mexico law, then charges will be brought. No one is above the law.”
