The homeowner associations of America are out of patience and money.
In the aftermath of the Surfside condo collapse and rising insurance rates, depleted reserve funds, and enhanced safety measures, hundreds of thousands homeowners associations across the nation are taking action against residents who have fallen behind on their payments.
HOAs skip grace periods, and instead hand over delinquent account to lawyers.
According to the Wall Street Journal and real estate analytics company Attom the number of HOA foreclosures increased by nearly 40% over the past two years, to 6,376 homes in the first three months. This pace is faster than the overall foreclosure rate for mortgages.
The Post quoted Kirk Pearson as saying that these foreclosure auctions are similar to most other foreclosures, in the sense that they usually involve an auction.
If the home is auctioned, then the owner has 90 days to redeem the property by paying all delinquent payments plus collection costs and fees. The HOA will take ownership of the home if there are no buyers at the foreclosure auction. “The HOA may then sell the property or transfer it to a bank with a senior lien-holder. It can also allow judicial foreclosure.”
Homeowners are often required to pay their past dues and fees, as well as legal costs in the period immediately following a foreclosing sale.
The Post reported that in some states like Pennsylvania the home owner has no “right of redemption,” which means when the sheriff sells the property, the house owner has lost the right to repay the debt. Stephen M. Hladik is a Pennsylvania mortgage foreclosure lawyer.
The HOA foreclosure sale can have various types of liens or encumbrances. A buyer should research the property to determine what liens are on the property and if they will survive the auction.
Pearson says that missed dues can be a small part of the total bill. The real cost is the escalating collection fees. Delinquencies are often outsourced to collection agencies that charge high fees on outstanding amounts.
The California lawyer noted that these firms were often owned by corporate lawyers who advise the HOA. The HOA legal team has a financial incentive to pursue foreclosures rather than help residents settle their debts.
HOA dues continue to rise for millions of Americans.
The Journal quoted Brian Fox, the co-founder and CEO of Benutech, a real estate technology company, as saying that HOAs were being forced to increase their collection efforts in order to prevent financial collapse.
Magnolia Cove is an 80-home neighborhood outside Charlotte in North Carolina. The monthly dues for homeowners associations have increased from $350 per month to $1250. A $10,000 special assessment has also been added.
The Journal reported that in 2025 HOAs will have filed more than 285,000 liens. This is an increase of about 8.8% compared to a year ago. Benutech tracks HOA foreclosures and delinquency.
HOAs have seen a rise in costs for staffing, materials, and insurance. One Long Island HOA’s annual insurance rate jumped from $60,000 to $360,000.
The cost of tighter safety regulations was also increased after the 2021 Champlain Towers South condominium partial collapse, which claimed the lives of 98 people.
Unpaid dues can lead to legal disputes and delays in upkeep. The cash crunch not only threatens individual homeowners, but also lowers the value of entire neighborhoods.
In many states, “super priority” laws even let HOAs foreclose over unpaid dues before banks can.
Fairview Condo 1 is allegedly in default on its $595 dues per month. This amounts to an $8,900 monthly deficit. Among them, ten are currently in foreclosure. The WSJ reported that the board has been imposing special assessments and delaying upkeep.
The WSJ reported that Floyd Mayweather Jr. owed $25,000 for unpaid taxes, starting January 2025. There was also interest and legal costs.
Mayweather’s lawyer said that the unpaid fees were due to an accounting error, which has been corrected following the recent revamp of Mayweather’s financial staff.

It was intended that the test would take place in a closed environment without internet connection, but in their letter, the Attorneys General alleged that an agent had exploited software vulnerabilities, left the isolated testing environment, and connected to internet.
Bird wrote that “OpenAI did not confirm whether its isolated and secure testing environment in fact was isolated and secure.” It was not.

Officials did not announce a lawsuit, but they said that the facts reported publicly could be used to support claims made under state laws enforced through attorneys general.

MDHHS statistics show that the deaths occur as cases have exceeded 11,000 in total, including 193 admissions to hospital.
MDHHS said that in most cases, cyclosporiasis does not pose a serious threat to life and deaths in the U.S. are rare.
Health officials in Michigan, eight other states and Canada have linked illnesses to the shredded lettuce used at Taco Bell.

The CDC previously stated that it was investigating other outbreaks of cyclosporiasis in the United States, which are not related to the outbreak of nine states.
According to the latest data from the CDC, since May 1, cases have risen above 18,000 across 45 states.
The data indicates that there are 6707 confirmed cases of cyclosporiasis in laboratories, with 423 hospitalizations.
There are also at least 11500 cases which have yet to be confirmed in a laboratory or need further analysis.
It can take the CDC up to six week to decide if a person is sick enough to be included in its tally. This means that national reported cases could be less than state totals.
The UK Health Security Agency published last week data showing an “acute rise” of cyclosporiasis among travellers returning from Mexico.
Between April 30th and July 15th, 67 cases were reported by returning travellers in England. Wales, and Scotland. A comparative average of 93 annual cases was recorded from 2022 to 2025.
UKHSA advised all travellers to be cautious when travelling abroad, including maintaining good hygiene with food and drinking water to minimize their risks of getting sick.
According to the CDC, Cyclospora is spread by food and water contaminated with feces.
